AP: The pardons, announced with just hours left in Biden’s presidency, have been the subject of heated debate for months at the highest levels of the White House. It’s customary for a president to grant clemency at the end of his term, but those acts of mercy are usually offered to Americans who have been convicted of crimes. Biden, a Democrat, has used the power in the broadest and most untested way possible: to pardon those who have not even been investigated.

Done under cover of the Trump inauguration, of the national global jubilation of a revenant Trump presidency. These 'pardons' need to be challenged in the court, by which I mean put-paid-to by SCOTUS. Let us be clear:

A PARDON IS NOT A QUITTANCE.

THERE CAN BE NO QUITTANCE WITHOUT A CRIME ALLEGED OR INDICTED OR TRIED.

A PARDON FOR A CRIME NEITHER ALLEGED NOR INDICTED NOR TRIED IS A LEGAL FICTION AT BEST, 

AT WORST, IT IS JUSTICE SUBORNED.

Had Biden kept to the expected pardon -- in the teeth of his repeated heated denials and solemn abjurations -- for his convicted corrupt son, people by and large would have let it slide as an act of parental patheticism. Let's see what SCOTUS has to say, Burdick v. United States, 236 U.S. 79 (1915):

• Acceptance, as well as delivery, of a pardon is essential to its validity; if rejected by the person to whom it is tendered, the court has no power to force it on him.
• This brings us to the differences between legislative immunity and a pardon. They are substantial. The latter carries an imputation of guilt; acceptance a confession of it. ...
• A pardon is an act of grace, proceeding from the power entrusted with the execution of the laws, which exempts the individual on whom it is bestowed from the punishment the law inflicts for a crime he has committed. It is the private though official act of the executive magistrate, delivered to the individual for whose benefit it is intended ... A private deed, not communicated to him, whatever may be its character, whether a pardon or release, is totally unknown and cannot be acted on.
• Formal acceptance is necessary to give effect to the pardons. If a pardon is rejected, it cannot be forced upon its subject.

Here are the quick takes from my reading of Burdick:

• A pardon imputes guilt.
• To have effect a pardon must be accepted -- and with it the imputation of guilt -- and entered into the court (delivery) in response to the pertinent indictment, verdict, or sentence.
• A person may reject a pardon and its taint, and the court has no power to effectuate its purpose. 

The Biden DOJ certainly thought pardons to be an open legal admission of guilt.

Interestingly enough, in the case of this morning’s pardons, the outgoing president admitted that he is pardoning people for imagined crimes as well as any real ones.

Interestingly enough, [Colleen Long and Zeke Miller] acknowledge that what Biden has done with his pardons falls far outside convention.

Here is my take: If the White House had any sense at all, any whatsoever — and indeed if the Leftists had truly mastered the art of propaganda — they should have tried to appear just the slightest bit bipartisan (or nonpartisan — you takes your pick) and added all the imprisoned J6 protesters to the pardons issued by Joe Biden today. 

They have spent 

(Indeed, why shouldn't Sleepy Joe have tried to pardon none other than… Donald Trump himself? Could he pardon Trump in the New York proceedings? It's (New York) state rather than federal, right? Biden could at least mention an attempt or a willingness to do so.)

Instead of reassessing their agenda, the White House's wokesters double down, trying to make the transition as wokish and as leftist as possible, trying to get whole new batches of illegal aliens into the country, trying to sell pieces of Trump's Southern wall at 1% (!) of the price, and pardoning or commuting the sentences of all matters of vicious thugs and murderers. Those are the parting gifts of one Joe Biden.

No, the Drama Queens are still living in a World of Pure Fantasy, a World of Deserving Dreamers Vs. Despicable Deplorables. What this proves — in case you hadn't noticed — is that they have been blazingly lying about it, and about everything else, for the past four years.

To date, Joe Biden has destroyed the American economy, overseen an invasion of illegal aliens, given Afghanistan terrorists advanced military weaponry and cost the lives of marines, facilitated Iran's funding of Hamas to conduct a terrorist attack on Israel and start a full-blown war in the Middle East, shut down the Nord Stream 2 pipeline to empower Russia and bring about the invasion of Ukraine, and had his dog bite two different people. But, according to the president, it's just not enough.

The subject of the book is what Peter Erntsved Rasmussen calls the systematic destruction of the kingdon's Defense for more than 30 years.

"Today it consists of ships that cannot sail. Planes that cannot fly. And cannons that cannot fire. Everything is missing, from soldiers, air defense, artillery, anti-aircraft defense, submarines, tanks, night combat equipment, weapons, ammunition, radios, and binoculars to things as banal as socks, notebooks, and printer paper," he writes in a press release, where he also addresses who is to blame for the Armed Forces' miserable condition.

"The book describes a national tragedy that could only be made possible because successive prime ministers, finance ministers, defense ministers, department heads, defense chiefs and top officers lied with open eyes, manipulated and withheld the truth about the state of the Armed Forces — and at the same time tried to convince the population that we had the world's best defense."

Moving away from "barracks in disrepair" and more specifically to the Kalaallit Nunaat situation, the founder of OLFI seems sympathetic to Donald Trump, as he writes that Denmark Has Been Snoring Deeply Regarding Greenland: 

The Danish government is in a state of disarray. Instead of bringing the relationship with Greenland into balance, successive governments have continued the overlord mentality. It is with good reason that the Greenlanders feel provoked. So does the United States, because we have never wanted to take security seriously. Now the bill is coming, and it will be expensive.

"A network of small complicated rules": Alexis de Tocqueville Predicted the Kind of Tyranny Modern Democratic Nations Would Face

The type of tyranny that Alexis de Tocqueville warned about (video) two centuries ago is right on the spot, according to TheLibertyDaily (merci à Duncan Hill), which goes on to point out out that it describes today's "bureaucratic nightmares." The video quote from Democracy in America comes (in bold) in the third paragraph below:

“Above this race of men stands an immense and tutelary power, which takes upon itself alone to secure their gratifications and to watch over their fate. That power is absolute, minute, regular, provident, and mild. It would be like the authority of a parent if, like that authority, its object was to prepare men for manhood; but it seeks, on the contrary, to keep them in perpetual childhood: it is well content that the people should rejoice, provided they think of nothing but rejoicing. For their happiness such a government willingly labors, but it chooses to be the sole agent and the only arbiter of that happiness; it provides for their security, foresees and supplies their necessities, facilitates their pleasures, manages their principal concerns, directs their industry, regulates the descent of property, and subdivides their inheritances: what remains, but to spare them all the care of thinking and all the trouble of living?

Thus it every day renders the exercise of the free agency of man less useful and less frequent; it circumscribes the will within a narrower range and gradually robs a man of all the uses of himself. In that perspective, here is another Tocqueville quote that I like:

“Democracy extends the sphere of individual freedom, socialism restricts it. Democracy attaches all possible value to each man; socialism makes each man a mere agent, a mere number. Democracy and socialism have nothing in common but one word: equality. But notice the difference: while democracy seeks equality in liberty, socialism seeks equality in restraint and servitude.”

And another:

“It's not an endlessly expanding list of rights — the 'right' to education, the 'right' to health care, the 'right' to food and housing. That's not freedom, that's dependency. Those aren't rights, those are the rations of slavery — hay and a barn for human cattle.”  

Then there is this longish quote:

“What good does it do me, after all, if an ever-watchful authority keeps an eye out to ensure that my pleasures will be tranquil and races ahead of me to ward off all danger, sparing me the need even to think about such things, if that authority, even as it removes the smallest thorns from my path, is also absolute master of my liberty and my life; if it monopolizes vitality and existence to such a degree that when it languishes, everything around it must also languish; when it sleeps, everything must also sleep; and when it dies, everything must also perish?

There are some nations in Europe whose inhabitants think of themselves in a sense as colonists, indifferent to the fate of the place they live in. The greatest changes occur in their country without their cooperation. They are not even aware of precisely what has taken place. They suspect it; they have heard of the event by chance. More than that, they are unconcerned with the fortunes of their village, the safety of their streets, the fate of their church and its vestry.
