The Green party mayor of Bègles, Noël Mamère, has announced that he will perform a gay marriage on June 5. This announcement has not pleased the French Minister of Justice, Dominique Perben, who stated that gay marriages violate the French Civil Code. In fact, Perben seems right. Article 75 of the Civil Code, which describes the procedure of a civil marriage, specifically refers to "husband and wife." Preempting a possible case before the European Court of Human Rights, Perben noted that Article 12 of the European Convention on Human Rights states: "Men and women of marriageable age have the right to marry and to found a family, according to the national laws governing the exercise of this right."
In an interview, Mamère stated that, if the French government intervenes to nullify the marriage, he expects them to do so a posteriori.
